1. Acceptance of Terms

By accessing or using the website at https://www.mad-river.org and the services provided by Mad River, PLLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Services

Our website offers self-discovery assessment tools (Connection Style Test, Enneagram Test, Big Five Test, The Blueprint, and Family Attachment & Cohesion Test) and information about the telehealth psychotherapy services of Daniel Elliott, LMHC-A.

3. Assessment Tools Disclaimer

Our self-discovery assessment tools are for educational and informational purposes only. They are:

  • Not clinical or diagnostic tools. They do not provide clinical diagnoses or medical advice.
  • Not HIPAA compliant. Your assessment responses, scores, and generated reports are not protected health information (PHI) and are not stored as part of any medical record.
  • Not a substitute for professional mental health evaluation or treatment. If you are in crisis, contact 988 (Suicide & Crisis Lifeline) or your local emergency services.
  • Not establishing a therapeutic relationship. Using our assessment tools does not create a client-therapist relationship with Mad River, PLLC or Daniel Elliott, LMHC-A.

4. User Accounts

You may create an account to save your assessment results. You are responsible for maintaining the security of your account credentials. Assessment tools can be used without an account, but results will not be saved to a dashboard.

5. Payments & Subscriptions

One-Time Purchases

Certain assessments (The Blueprint, Family Attachment & Cohesion Test) require a one-time payment. Payment is processed by Stripe before you can access the assessment. All sales are final once the assessment has been started.

Mad River Insights Subscription ($7.99/month)

The subscription unlocks personalized Big Five personality reports, cross-test synthesis, and free FACT partner sharing. Key terms:

  • Billed monthly at $7.99/month through Stripe. No free trial.
  • Cancellation: You may cancel at any time through the Stripe billing portal accessible from your dashboard. Your subscription remains active until the end of the current billing period.
  • Access upon cancellation: When your subscription ends, you lose access to subscription-only features (personalized Big Five reports, cross-test synthesis, and free FACT partner sharing). Your saved assessment scores and previously generated reports remain accessible on your dashboard.
  • No refunds for partial billing periods.

6. AI-Generated Content

Some assessment reports are generated using artificial intelligence (Anthropic's Claude). While we strive for accuracy, AI-generated content may contain inaccuracies or generalizations. These reports are for personal reflection and self-discovery only — they do not constitute professional advice.

7. FACT Partner Sharing

The Family Attachment & Cohesion Test offers a partner sharing feature. When you create a partner share link:

  • Your partner can take the FACT assessment through the shared link without needing an account.
  • Both participants receive a comparison report via email.
  • By creating a share link, you consent to your FACT results being included in the comparison report sent to your partner.
  • The comparison report is for educational purposes only and is not a clinical assessment.

8. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose or in violation of any applicable laws.
  • Attempt to access other users' accounts or data.
  • Use automated tools to scrape, crawl, or extract data from our website.
  • Interfere with or disrupt the functionality of our services.

9. Intellectual Property

All content on this website, including assessment questions, scoring algorithms, report templates, and AI prompts, is the property of Mad River, PLLC. You may not reproduce, distribute, or create derivative works from our content without written permission.

10. Limitation of Liability

Mad River, PLLC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Spokane County, Washington.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes constitutes acceptance of the updated terms.
